Rule Book

The Rules form the basis of members' policies of insurance with ITIC.

The 2024 Rules will apply to any policy of insurance which commences, or renews after 1st June 2024. Any policy incepting prior to 1st June 2024 will be subject to the 2023 Rules. For a full comparison of the rule changes please download the comparison PDF below. Please contact us if you require any clarification.

The ITIC Europe rule book is applicable to members in the EEA who have ITIC Europe policies, i.e., those who renew their policies on or after 14th February 2024. Translations of ITIC's Rule Book are for information purposes only and no reliance should be placed upon them for the purposes of any insurance provided by ITIC. In case of any discrepancy between the translation and the English text, the English text will prevail.

ITIC has established a subsidiary operation in Cyprus through which to underwrite its EEA business. That company, International Transport Intermediaries Insurance Company (Europe) Ltd, ITIC Europe, was incorporated in Cyprus on 11 September 2023.

Difference between ITIC Rules and ITIC Europe Rules

Please note the ITIC Europe Rules 2024 are completely based on the ITIC Rules 2024 and are intended to offer those insured by ITIC Europe the exact same level of cover to which members of ITIC have always benefited. ITIC Europe is a wholly owned subsidiary of ITIC and therefore logical amendments have been made to the ITIC Rules reflecting the new arrangement, to create the new ITIC Europe Rules. The following is a high level summary of the changes that have been made:

1.   Where necessary references to Club are changed to mean ITIC Europe instead of ITIC;

2.   “Articles of Association” now mean the Articles of ITIC Europe. ITIC’s Articles are “the ITIC Articles”;

3.   “The Rules” mean the ITIC Europe Rules and ITIC’s Rules are defined as “the ITIC Rules”.  

4.   The concept of “corporate membership” of ITIC has been introduced so that entities insured by ITIC Europe are also corporate members of ITIC; 

5.   Part 8 “Cesser of Insurance” now additionally includes cesser of corporate membership;

6.   References to “Directors” mean the Directors of the Club (ITIC Europe);

7.   The address for service has changed from ITIC’s London address to ITIC Europe's Cyprus address.

As a result of the Russia-Ukraine conflict the ITIC board of directors have reviewed the provisions within the ITIC rules regarding both sanctions and the ability to terminate a member’s entry with ITIC.

ITIC’s current Rule 13.32 provides that there would be no cover if ITIC is at risk of breaching the sanctions described in that rule, which are limited to the EU, UK and USA. A number of other countries have their own sanctions regimes. Accordingly, it was felt that the sanctions clause needed to be widened. There is a further widening of Rule 13.32 to allow ITIC to suspend or terminate cover if ITIC is exposed to or at risk of being exposed to sanctions, prohibitions or adverse actions.  In addition it was felt that new provisions should be included within the ITIC Rules which would allow ITIC to suspend or terminate cover in the event that a situation arises which the Directors believe could cause reputational damage to ITIC.  Finally, a new automatic cesser of insurance has been added if a member becomes subject to sanctions, prohibitions or restrictions of the UK, USA, EU or UN. Details have been provided in the above ITIC Rules amendment explanation document.

Revised ship, yacht and crew management endorsements

With the issuance of the BIMCO Shipman 2024 and BIMCO Crewman 2025 agreements, it was felt appropriate to review the wording of ITIC’s ship, yacht and crew management endorsements. 

The changes implemented are to make the endorsement conditions and exclusions clearer. 

  • Cover is insured on the basis of terms no more onerous than those used in the 2009 or later versions of the BIMCO agreements. The 1998 version is no longer referenced, given that this is over 25 years old and 2 subsequent versions have since been published.
  • The wording of the co-assurance requirement condition has also been clarified, with the insurances to include at least full P&I and H&M cover. For crew managers, the condition is for members to exercise best endeavours to be named as co-assured.
  • The exclusion wording for risks arising out of the breach of Classification Society rules has been simplified.
  • Likewise the exclusion wording for the supply of goods has been reworded to make it simpler and clearer and and attention is drawn to the products liability exclusion at Rule 13.5.

The changes implemented are mostly to make the endorsement conditions and exclusions clearer, with most additional wording reflecting the existing position under the Rules.

  • The wording clarifies that the underlying contract must have been terminated pursuant to an existing contractual right under the contract, not merely due to a commercial decision by the parties. This is repeated in the “Exclusions” section.
  • Additional wording clarifies that constructive total loss is where confirmed by the ship’s underwriters.
  • “Allision” has been added (to collision) so this event is also covered.
  • The Rule 13 exclusions wording and the exclusion and cancellation wording for outbreak of war have been moved from the “Conditions” section to the “Exclusions” section.
  • As per the rules, risks arising out of or in connection with sanctions issues are not covered. This is repeated in the “Exclusions” section
  • It is clarified that there is no cover if the reason for termination of the contract was or should have been known by the member before the conclusion of the contract. 
  • The member’s existing duty to mitigate is emphasised.
  • Additional wording sets out the payment mechanism for a claim under the policy.

Insurance Product Information Documents

The Insurance Product Information Documents (IPIDs) are a summary of the benefits included, exclusions, restrictions, areas of cover, how your policy is paid and your rights and obligations.

ITIC provides two sets of IPID documents, one for EEA members and another for non-EEA members. Based on where your business is registered, please select the relevant entity below (it will be stated on your policy and the certificate of insurance). These documents are the same, aside from the name of the insurer.
