ITIC Circular - Implementation of the General Data Protection Regulation – general guidance to members and brokers

The General Data Protection Regulation (GDPR) will come into force on 25 May 2018 and will have direct effect in the European Union (EU), including the United Kingdom (UK) and the European Economic Area (EEA).

The GDPR relates to information regarding an identified or identifiable living natural person or individual.  Its intention is to strengthen and harmonise EU/EEA and UK procedures and protect individuals concerning the collection, storage, processing, access, use, transfer and erasure of personal data. 

This circular is our confirmation to members (and their insurance brokers) of ITIC’s compliance with its obligations under GDPR. Neither that information nor this circular should be construed as providing legal advice.

GDPR will apply to members not only located in the EU/EEA/UK but also to those situated outside those areas that offer goods or services to individuals within the EU/EEA/UK, or send personal data to recipients within the EU/EEA/UK or in connection with EU/EEA/UK citizens.

Members should consider the requirements of the GDPR applicable to their businesses, assess their exposure and put in place appropriate procedures and controls in order to comply. ITIC is not in a position to advise upon how GDPR may impact upon individual businesses and members should seek appropriate advice from a lawyer or their local Data Protection Authorities.
